Full-Scope and Service

In this model, Indy Colbath is your “attorney of record,” meaning that any paper filed on your behalf in court has her name and firm information in the caption. Indy will be responsible for moving the case along and she is the point of contact for the court, the opposing party and or the opposing attorney. If your matter does not require any court filings, Indy is still your representative for all issues related to your case.

Limited Scope

If you have an upcoming hearing that you would like representation for, this may be the right choice for you. In a limited scope arrangement, Indy represents you in one hearing, or through the adjudication of a single issue or multiple issues in your case. Indy will be the point of contact for any communication regarding that issue, but you will be responsible for all other aspects of your case.

For example, if you are in the middle of a divorce, and there’s a hearing coming up for a request for child custody, child support, and spousal support, if Indy is your limited scope attorney for that hearing, she will be responsible for making that appearance, submitting any pleadings on your behalf, and ensuring the order after hearing is filed. In this example, she would not be responsible for finalizing your divorce, including settling the division of property.

Advising Attorney

If you and your spouse are participating in mediation, or you want to continue representing yourself in your matter but you could use some legal advice “behind the scenes,” hiring Indy as an advising attorney may be the best option for you. As an advising attorney, Indy can inform you about the law, and use her experience as a courtroom advocate to coach you in representing yourself in any court hearing. She can also discuss various settlement scenarios with you, and proofread any pleadings, communications, or other written content that you create. Family law mediators tend to recommend that both sides have their own respective advising attorney who can assist the party in ensuring that they are advocating for themselves and making agreements that are legally sound and, in that party’s best interest.

Document Preparation

If you wish to do your own divorce, but are intimidated by the multitude of court forms you need to prepare and file, then document preparation may be your best bet. If you select this option, you will work primarily with the firm’s skillful paralegal, Brennan Hines.

For this option, we do not offer legal advice — we simply take the data you provide us, and distill it into the court forms that are required to complete your case. As part of this option, we will draft your final divorce agreement, or “Marital Settlement Agreement” and all the accompanying forms that go with it, but you and your spouse must come to your agreements on your own. This option is typically the least costly option.

For this reason, we are flexible with the services we offer, and can always “downgrade” the level of service we are providing, or, in certain instances “upgrade” the level of service, provided that there is availability to do so.
